Offences Against Women

The gulf between a male and woman has definitely been an evil creature that is feeding off the female tier of society. There wouldn’t be any women in India should we not take action now. It is reported that the National Crime Records Bureau has recently published figures on sexual assaults on women. According to the figures, 100 women suffer sexual assault every day, or around.

The highest number of cases are found within the State of Madhya Pradesh. In M.P. there was an increase of 358% rapes against women between 2013 and 2014 i.e. 14 a every day. On the other hand, Uttar Pradesh excels in murder and kidnapping, of which 300 murders were attributed to relationships with lovers. Delhi is the best in theft. In India almost 2.5 million cases were reported as kidnappings in five years. The majority of them did not require exorbitant amounts, but were intended for marriage purposes.

Kidnapping

The term”kidnapping,” is a reference to either kidnapping from India as well as kidnapping in legal guardianship. Section 360 in the IPC stipulates that anyone who carries any person outside India without consent is deemed to kidnap that one from India and anyone who takes from a person who is a minor (16yrs for males and 18 years in the case of female) without consent of the parent or that of a guardian’s consent, is deemed to kidnap the person from the lawful care (Sec 361). The penalty for this offense is a maximum of 7 years in prison and fine. Section 366 of the IPC defines abducting, kidnapping or inducing a woman to force her to marry and sexual force relationships for which the perpetrator is liable to prison for up to 10 years and fine.

Eve Teasing

Eve Teasing can be described as a term that refers to molestation, or public sexual harassment of females by males. It is a major issue among the youth of today. It’s a form of sexual violence that varies in intensity from sexual remark such as catcalls and brushing to sexual groping. Sec 509 of IPC provides that any person who aims to smear the modesty women, speaks any words or makes any sound, gesture, or displays any object that interferes with the privacy of a woman will be punished by three years of imprisonment and a fine.

Chain Snatching

The only way to get women’s money is through the snatching of chains and other valuables. It is a prevalent issue of our society. Women over the age of 50 are the victims offenders. They also disguise themselves as police officers and demand women give their valuables to them for the sake of security. It is subject to Section 378 of the IPC.

Rape

It is a broad term that needs to be defined, and has a larger scope. This is by far the most prevalent crime committed against women, and Indian society and its system have failed to eradicate this horrific crime. The world is observing India as a country of the rapists. The number of rapists have risen tremendously. The laws have failed completely. The offence is classified in a variety of ways, including sexual assault of a minor or female (Sec 376) and rape that involves murder (Sec 376A) and rape within families and by public employees (Sec 376C) and the gang-rape (Sec 376D) and sexual rape in the marital relationship (Sec 376B). The penalties for these crimes vary from jail time up to 7 years up to 20 years or life imprisonment, and fines.

Sexual Harassment

Sexual harassment is defined as unwanted sexual advances or solicitations for favors sexual, and other physical or verbal harassing of a sexual nature. It encompasses a variety of conducts ranging from slight infractions to sexual abuse, sexual assault, displaying pornographic material to women at wishes, etc. According to Section 354A of the IPC If a person is found guilty of the act of harassment sexually, the offender is liable to a lengthy prison sentence of up to 3 years in prison and fined.

Domestic Violence

Domestic Violence is another word that is very common in the United States, since women were considered as being the lowest class of society. The thought process was that the man was a worker and earned money and therefore had the right to indulge in whatever he wanted in the presence of his spouse. However, as time passed changes, and women are now equally employed. The types of violence are beatings, rape, and forced sex, etc. Section 498A in the Domestic Violence Act, 2005 provides 1 year of punishment and a fine.

Honor Killing

A string of murders and crimes that are dishonourable that are a result of honour no matter if it’s the caste, family or community continues to be documented. However, the majority of these deaths and crimes are recorded from different states in India. An act of violence in the name of honour is a type of violent or abusive actions that include physical, emotional, and sexual

Abuse and other coercive actions. Panchayats, or associations by a variety of punitive and coercive actions are seeking to cause fear and prevent marriages and associations in the name of choices from occurring. They also violate of the fundamental rights guaranteed by the Constitution of India, including the right to life and liberty, which is a right that includes bodily integrity as well as the right to select who to associate with.

Cyber Crimes

In the world of tech, India too had advanced its technology, and women make up a large part of that. However, the brains of those with diseases haven’t given up any opportunity to be a nuisance to women in the online world as well. There are a variety of cyber-related crime, such as abuse, bullying pornography, bullying etc that happen every day against women. Criminals who commit these crimes face a variety of punishments as per the Information Technology Act, 2000 that range from a sentence of imprisonment to 3 years, to L.I. and fines.

Dowry Deaths

The sham practice of obtaining the dowry when getting married is prevalent in the rural areas of India which, if not resisted, leads to the death of women over time. The number of deaths due to this practice has increased in recent years.

Acid Attacks

But the sale of acids without proper warnings have been prohibited from the Indian government. India Acid attacks still a common practice to harm women and cause harm to women. Section 326A and 326B of the IPC states that any person who willingly throws acid in the face of the purpose of causing grievous injury or attack will be punished with seven years of imprisonment or L.I. and a fine.

Stalking

The crime of stalking is currently which is becoming more popular among women. Stalking is a breach of women’s privacy by keeping track of regular or frequent contacts, or monitoring online or any other form of electronic communication. Any person who violates this rule will be punished by imprisonment ranging from 3 years to 5 years and a fines.

To slam modesty

Anyone who assaults or uses unlawful force with the intention of causing offence to their modesty (1yr-5yrs jail) or disrobes her, or forcing her to wear naked (3yrs-7yrs prison) is liable for a violation under Section 354 as well as Sec 354B, respectively.

 

Trafficking in women

Offences against women or the idea of women trafficking was first introduced in the twentieth century in India and continues to be present. Sec 370 outlines various forms of trafficking that include the trafficking in minor girls, and trafficking with purposes of exploiting and so on.

Section 372 and 373 outlines the purchase and sale of minors in order to provide prostitution. The term of imprisonment is different for every case and ranges from 3 years up to life imprisonment, and can also be fine.

There were a variety of offenses and the punishments they entail in the Indian Penal Code related to women. Government officials of India has taken steps to protect women by introducing several acts such as sexual harassment of women in the workplace Act 2013, and Protection of children from sexual offenses Act 2013, etc. 

The Act also amends the IPC as well as the Code of Criminal Procedure. The government is determined to pass laws on dowry-related crimes and honor killing. Cybercrime will be dealt with at some point or another. In recent times due to the changes in society, women have become willing to fight for themselves and have received a lot of support.
